Terms and Conditions for FB-Pro (UK)

Welcome to FB-Pro, the production filmmaking arm of Film Buddy. By accessing or participating in our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully. If you do not agree with these terms, you must not use our services.

1. Introduction

FB-Pro, operated by Film Buddy (“we,” “us,” or “our”), offers production opportunities in real film, TV, and animation projects to young aspiring filmmakers and industry professionals. These Terms and Conditions apply to all users, including participants, collaborators, mentors, and other individuals involved with our productions.

2. Eligibility

2.1 Age Requirements:
Participants must be at least 16 years old to engage in our activities. Individuals under 18 years of age must have written consent from a parent or guardian and comply with any additional requirements as set out by UK law, including working hours and safeguarding measures.

2.2 Professional Conduct:
Participants are expected to conduct themselves professionally at all times. This includes adherence to industry standards, respect for all team members, and compliance with health and safety regulations.

3. Our Services

FB-Pro provides a range of production-related opportunities, including but not limited to:

        •       Hands-On Filmmaking Experience: Participation in real film, TV, and animation productions.
        •       Mentorship: Guidance from industry professionals.
        •       Training and Workshops: Skills development sessions tailored to industry needs.

4. Application and Participation

4.1 Application Process:
Participants may be required to submit an application or attend an interview. Selection is at our discretion and based on criteria relevant to the specific production or activity.

4.2 Participation Agreements:
Participants may be required to sign agreements detailing their roles, responsibilities, and any other specific terms related to the production.

4.3 Work Experience Placements:
FB-Pro may facilitate work experience placements, but participation does not guarantee future employment or specific career outcomes.

5. Intellectual Property

5.1 Ownership:
All content created during FB-Pro activities, including films, animations, scripts, and other materials, will be owned by Film Buddy unless otherwise agreed in writing.

5.2 Usage Rights:
Participants grant FB-Pro and Film Buddy the right to use, reproduce, distribute, and publicly display any work created during the course of the production for promotional, educational, or commercial purposes.

6. Health, Safety, and Safeguarding

6.1 Health and Safety:
We are committed to providing a safe environment for all participants. Participants must adhere to all health and safety instructions and report any concerns immediately.

6.2 Safeguarding:
FB-Pro follows safeguarding protocols in line with UK legislation, including the protection of young and vulnerable individuals. All mentors and professionals involved in productions are required to undergo relevant background checks, including DBS (Disclosure and Barring Service) checks where applicable.

7. Liability and Indemnity

7.1 Limitation of Liability:
To the fullest extent permitted by law, FB-Pro and Film Buddy shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in our activities.

7.2 Indemnity:
Participants agree to indemnify and hold harmless FB-Pro, Film Buddy, its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses arising from their participation, including but not limited to breaches of these Terms and Conditions.

8. Insurance

FB-Pro maintains public liability insurance in accordance with UK law. Participants are advised to have their own insurance cover for personal property and liability as appropriate.

9. Code of Conduct

Participants are expected to adhere to a professional code of conduct, including:

        •       Respect for All Team Members: Treat others with respect, fairness, and professionalism.
        •       Punctuality and Commitment: Arrive on time and fully engage in all agreed activities.
        •       No Discrimination or Harassment: Zero tolerance for any form of discrimination, bullying, or harassment.

10. Termination

10.1 Termination by Us:
FB-Pro reserves the right to terminate a participant’s involvement at any time for breach of these Terms and Conditions, misconduct, or other reasons deemed appropriate.

10.2 Termination by You:
Participants may withdraw from activities by providing reasonable notice. Any specific terms regarding withdrawal will be outlined in individual participation agreements.

11. Data Protection and Privacy

We are committed to protecting your personal data in compliance with the UK GDPR and Data Protection Act 2018. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

12. Changes to These Terms and Conditions

FB-Pro reserves the right to update or modify these Terms and Conditions at any time. Participants will be notified of significant changes, and continued participation will constitute acceptance of the updated terms.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
